Chinese courts take a different approach to the issue of AI generating copyright protected images, the DLA Piper team reports. On 7 March 2025, the Changshu People’s Court (in China’s Jiangsu province) announced that it had recently concluded a case on the topical issue of whether AI-generated works can be protected by copyright. In the case, a plaintiff surnamed Lin used the AI tool Midjourney to create an image, and then Photoshop to further refine it.

His view is that avoiding “system melt-down” seems wiser than dealing with it afterwards. Suppliers test systems to assess whether they do what they should do (functional testing) in a way that meets the customer’s need (non-functional testing). As such, it is the principal approach used to assure quality.

The Competition and Markets Authority (CMA) has launched strategic market status (SMS) investigations in a second area of digital activity: mobile ecosystems. Two investigations into Apple and Google respectively will assess in parallel their position in their respective “mobile ecosystems” which include the operating systems, app stores and browsers that operate on mobile devices.
