    A divided Wisconsin Supreme Court agreed Friday to hear a state constitutional case brought by voters challenging the state’s Republican-drawn legislative maps. That same day, Justice Janet Protasiewicz, who was elected to the court in April, denied a recusal request from the GOP-controlled legislature. Protasiewicz’s election, which shattered national records for judicial election spending, brought a liberal majority to the court for the first time in 15 years.

    Since the reversal of Roe v. Wade in Dobbs v. Jackson Women’s Health Organization, state courts have moved to the center of the nation’s abortion wars. There are still key battles in federal court: over the application of the Emergency Medical Treatment and Labor Act to state laws denying abortion access in medical emergencies or challenges to the Food and Drug Administration’s authority to approve the abortion drug mifepristone.

This year, we updated the analysis with data on the composition of state supreme courts as of May 15, 2023, including updated information on justices’ demographic and professional backgrounds.
