On 30 April 2024, the Representative Actions for the Protection of the Collective Interests of Consumers Act 2023 (the "Act") was commenced by order of the Minister for Enterprise, Trade and Employment (the "Minister"). In a previous briefing, we summarised the Act. The purpose of the Act is to transpose Directive (EU) 2020/1828 on representative actions for the protection of the collective interests of consumers, repealing Directive 2009/22/EC and to provide for related matters.

On 5 July 2023, the Courts and Civil Law (Miscellaneous Provisions) Act 2023 (the "Act") was signed into law by the President of Ireland. Once commenced, the Act will amend the Arbitration Act 2010 and permit third-party funding of international commercial arbitration. Litigation funding, where a third-party provides financing to allow legal proceedings or an arbitration to progress, is not currently allowed in Ireland, save for limited exceptions.
