The U.S. Department of Labor (DOL) recently issued proposed regulations on automatic portability programs. These programs help employees who change jobs consolidate their retirement funds by automatically transferring IRAs from their former plans to their new employers’ plans. For 2024, the minimum automatic IRA transfer amount under an automatic portability program is $7,000.

A California appeals court recently overturned a trial court’s dismissal of an employee’s age discrimination claim, finding that his job transfer may have constituted a demotion. Although the employer claimed that the man had voluntarily accepted a new position, some evidence indicated that the man had been involuntarily demoted. The case is Ilaga v. The Permanente Medical Group, Calif. Ct. App., No. A165273 (Nov. 22, 2023).

A panel of the U.S. Court of Appeals of the Tenth Circuit recently heard oral arguments in a proposed class action lawsuit involving Amazon warehouse workers and the computation of overtime pay. The U.S. Equal Employment Opportunity Commission (EEOC) does not require employers to report employees as nonbinary on the EEO-1 form. While the form contains separate boxes for employers to designate male and female employees, there is no such box to designate an employee as nonbinary.
