On May 27, the Supreme Court announced that it would not review a decision by the Boston-based US Court of Appeals for the First Circuit, which held that the Middleborough, Massachusetts, school district did not violate the First Amendment free speech rights of a middle school boy who was sent home from school for refusing to take off a T-shirt that stated “There Are Only Two Genders” when he was told to do so by the school’s principal.

A three-judge panel of the US Court of Appeals for the 11th Circuit ruled 2-1 on May 13 to uphold a statewide preliminary injunction against enforcement of Florida’s S.B. 1438, a statute intended to shield minors from exposure to drag shows that the legislature considers to be harmful for them to attend. The judges in the majority, Robin Rosenbaum and Nancy Abudu, were appointed by President Barack Obama and President Joe Biden.

The US Supreme Court heard arguments on April 22 in Mahmoud v. Taylor, in which a group of parents of elementary school students in the Montgomery County School District in Maryland are challenging the district’s decision to deny parents the right to have advance notice and “opt out” their children from lessons in pre-K through grade 5 that use books that include LGBTQ characters and touch on LGBTQ issues, such as same-sex marriage, Pride parades, and childhood same-sex crushes.
