The First Chamber of Mexico’s Supreme Court (the “Court”) issued a decision by which it clarified the limits to the freedom of contract principle in a supply agreement. A supply agreement entails the periodic delivery of goods by a supplier to a client, in exchange of a consideration in cash. It is common practice that the parties to supply agreements keep the right to early terminate unilaterally the contract, without the other party’s permission or the need of a court relief.

Alaska Airlines Offers Refund + $1500 to Passengers Alaska Air has offered to refund passenger tickets and has offered $1,500 to help passengers with incidental expenses. This amount is not adequate compensation for what the passengers went through. Under the law the passengers and crew of Flight 1292 are entitled to full and fair compensation for what they experienced on the flight. It is perfectly fine to accept the small payment offered by Alaska Airlines if it comes with no strings attached.

The First Chamber of the Mexican Supreme Court of Justice (SCJ) confirmed that air carriers must compensate passengers if they are denied boarding due to overbooking of a flight. In recent days, an extract of the judgement of the constitutional trial in review 401/2023 containing the above criterion was made public. Due to overbooking of seats a passenger was denied boarding from a Paris-Barcelona flight that departed on September 14, 2017.
