The standards have been a point of contention for months at the capitol and with the State Board of Education. Since the board's February meeting, the three new board members recently appointed by Gov. Kevin Stitt — Mike Tinney, Ryan Deatherage and Chris Van Dehende — have repeatedly raised concerns about what they saw was an unfair process.

According to NPR, more than 280 colleges and universities in at least 23 states have seen Student and Exchange Visitor Information System (SEVIS) terminations. Following SEVIS termination, a student's visa is usually revoked. Judges in more than 50 cases have issued orders to the Trump administration to reinstate student records in SEVIS. The Department of Justice announced April 25 it would restore SEVIS records. However, the administration said it has plans for a new policy for students on visas.

Citing poor student test scores and "needless political drama," Stitt ousted three board members in February who faithfully voted with Walters for two years. The remaining members are the only two who weren't at the previous board meeting that saw the passage of new administrative rules to count undocumented school children — rules Stitt has come out against.
