On 7 April, US House Committee on Energy and Commerce (Energy and Commerce Committee) Chairwoman Cathy McMorris Rodgers (R-WA) and US Senate Committee on Commerce, Science, and Transportation (Commerce Committee) Chairwoman Maria Cantwell (D-WA) released a discussion draft entitled the American Privacy Rights Act of 2024 (APRA). If enacted, the APRA would establish the first national comprehensive consumer data privacy rights law in the United States and could have a sweeping impact.

On 7 October 2023, California Governor Gavin Newsom signed into law landmark legislation mandating corporate climate and climate-related financial risk disclosures. Together, SB 253 and SB 261 apply to public and private companies with annual revenues above certain thresholds and will impose Scope 1, 2, and 3 GHG emissions reporting requirements. Senate Bill 253 takes broad aim at public and private businesses that have more than US$1 billion in annual revenues and do business in California.

ESG Activity in the House Financial Services Committee (HFSC) Prior to departing for the August recess, Chairman Patrick McHenry (R-NC) wrapped up the month-long series of hearings considering digital assets and environmental, social, and governance (ESG) legislation. In tandem markups held on 26 July and 27 July, HFSC advanced several bills on these issues, both on a bipartisan basis (digital assets and stablecoin) and along party lines (anti-ESG bills).
