New South Wales builders will be forced to fix defects before
finishing a new home under laws set to pass this week,
strengthening the powers of the state's building watchdog. Current legislation only permits inspectors to issue a
rectification order after construction is complete and a buyer has
complained.

On 12 October 2023, the NSW Government introduced the Building Legislation Amendment Bill 2023 (the
Amendment Bill) to the NSW
Parliament. It passed the NSW Legislative Council on 19 October
2023, read the here and is currently with the
Legislative Assembly, awaiting concurrence.
The Amendment Bill is stage one of the reforms' roll out.

Changes to the Civil and Administrative Tribunal Act 2013 (NSW)
(NCAT Act) commenced on 20 September 2023
following assent to the Civil
and Administrative Tribunal Amendment Act 2023 (NSW)
(Amendment Act).
The Amendment Act implements recommendations that arose out of
the
Report of the Statutory Review of the NCAT Act, tabled in
December 2021. This report concluded that the NCAT Act was
generally appropriate to achieve its objectives specified in
section 3.

From 28 November 2023, amendments to the Privacy and Personal Information Protection Act 1998 (NSW) (PPIPA) will begin, introducing mandatory data breach notification obligations. These PPIPA reforms introduce a Mandatory Data Breach Notification Scheme (MDBN scheme) which will apply to all NSW public sector agencies (agencies), including NSW agencies and departments, statutory authorities, local councils, state-owned corporations, Ministers’ offices and some universities.

The Tribunal's jurisdiction under section 48K of the Home
Building Act 1989 (NSW) (HBA) is full of
curiosities. For example, although many causes of action for
building claims have a limitation period of six years, they can
only be brought in the Tribunal (as opposed to elsewhere) within
three years of the supply.
It has long been a source of confusion as to whether these
shorter limitation periods operate as a constraint on statutory
warranty claims and how the various periods interact.
