The Act requires them “to ensure, to their best extent, a sufficient level of AI literacy” among staff and others who operate and/or use AI systems on their behalf. What is AI Literacy? A court in Hamburg, Germany, has decided a copyright infringement case in a way that sheds light on how European courts may apply the text and data mining (TDM) exemption to AI model developers. The exemption is contained in EU Directive 2019/790 on copyright and related rights in the Digital Single Market Directive. The TDM exemptions are detailed here. The European Parliament approved the Network and Information Security 2 Directive (“NIS 2”) last year, expanding the scope of the Network and Information Security Directive (“NIS”). Now Germany has introduced the draft of the “NIS 2 Implementation and Cyber Security Strengthening Act,” which previews the approach the German government may take – an approach that other Member States may follow. EU Member States have until 17 October 2024 to enact NIS 2 into national legislation.
