Excluded from minimum wage and union rights, gig workers, disproportionately Black, grapple with a two-tiered system rooted in historical labor laws that must be reformed for racial and worker justice. During the Great Depression, the United States aimed to enhance workers' rights through New Deal legislation, exemplified by the Fair Labor Standards Act (FLSA). But by design it excluded Black workers.
