FLSA increases the annual compensation requirement for HCEs from $107,432 to $151,164, with subsequent updates expected starting in 2027. The HCE exemption allows certain employees to avoid overtime if they earn at least $107,342 and perform at least one administrative or exempt executive duty. Organizations can reclassify HCEs as non-exempt, raise their pay above the new salary threshold, or adjust their job responsibilities to align with full EAP duties.
