A Texas man who pleaded guilty to conspiracy to commit bank and wire fraud showed that he improperly received an excessive restitution order as punishment, the US Court of Appeals for the Fifth Circuit said. A district court’s $286,359 restitution order for William Dexter Lucas erroneously included an award for social security benefits fraud, said Judge Dana M. Douglas in an opinion partially vacating a lower court’s decision.

The parties told the US District Court for the Northern District of Illinois April 18 that the company will pay the government $300 million, of which $150 million will constitute restitution.
