Thursday Ohio Attorney General Dave Yost published a story with National Review and sent the ACLU lawsuit against the SAFE Act portion of House Bill 68 into a tailspin. When an administration invokes whole of government, it is mustering all the agencies under its command to a preferred goal. Thus the Securities and Exchange Commission, designed to regulate stock exchanges, is pressed into service to battle climate change. The Environmental Protection Agency, designed to promote clean air, land and water, is dragooned into energy and industrial policy. Such approaches haven’t fared well in the courts.

Dave Yost is Ohio's attorney general. A fellow who runs a construction business asked me recently what would happen if Ohio Issue 2 passes this fall, making it legal to use marijuana recreationally. He's worried about people coming to work stoned and hurting, or even killing, other people. Still another thought Issue 1 would amend the U.S. Constitution. As with the bail bond issue from last November, there is misunderstanding, misinformation and just plain misses all over the place.
