The Supreme Court of Texas recently ruled that franchisor Massage Heights did not owe a duty of care to a massage customer who alleged a sexual assault, because, among other reasons, Massage Heights had neither the contractual right to control nor did it exert actual control of the employment decisions of the franchisee. A federal court in Ohio recently granted, in part, defendants’ motion to dismiss various TVPRA claims and denied their motion to transfer in a suit concerning alleged sex trafficking at two Red Roof Inn locations in Virginia Beach. A.M.G. v. Red Roof Inns, Inc., 2025 WL 588645 (S.D. Ohio, Feb. 24, 2025). In December 2023, plaintiff A.M.G. sued defendants Red Roof Inns, Inc. and six alleged corporate affiliates as well as a franchisee.
