Judge Cannon has temporarily enjoined Jack Smith from doing so. Her order is here. And the 11th Circuit has ordered Smith to respond by 10am tomorrow (!!) on this issue.

Fifth Circuit Judge Edith Jones went off on Professor Steve Vladeck. But her attack, ironically, is extremely personal and really makes no sense. She is upset that Professor Vladeck has been critical of the Shadow Docket and judge-shopping in one judge venues. This Law & Crime article has some of the details, although it's hard to summarize just how mean and over-the-top Judge Jones was. Here's the video if you'd like to watch.

Rest assured, the inverted narrative of persecuted persecutor only grows in power and persuasion when it is underwritten, as it is for Israel, by claims of ancestral inhabitation and the living memory of an extermination campaign so existentially threatening as to have inscribed the fear of persecution, seemingly once and for all, into the marrow of an already historically persecuted group.

He sent the letter to President Biden today and will be taking senior status effective 12/31. That means President Biden will have the opportunity to nominate someone for that seat. A huge shout out to Judge Wilson, who has been one of our wonderful judges on the 11th. Always prepared for oral argument and not afraid to take the difficult position if that's what the law requires. Onward!
