STATE CAPTURE After two years of legal filings, lawyers for the Zondo commission and former Eskom CEO Matshela Koko are due to meet in court for the first time. The case has been filed on the unopposed court roll after the commission failed to file any affidavits since 2022. Zondo’s lawyers believe this is grounds for the court to find in his favour, while the commission argues that Koko has failed to run his case properly.

Judicial analyst Mbekezeli Benjamin says Motata could have other legal avenues. Three artisanal miners who recently emerged from abandoned mine shafts in Stilfontein in North West have told the Constitutional Court about the abhorrent conditions underground. The NGO Mining Affected Communities United in Action wants the court to sanction police and other government actors.
