On a petition for rehearing en banc, the U.S. Court of Appeals for the Fifth Circuit recently held in Consumers' Research v. FCC1 that the current funding mechanism for the Universal Service Fund (USF) is unconstitutional and remanded the case to the Federal Communications Commission (FCC or Commission) for further proceedings.
