You can argue a narrow interpretation during grant and validity proceedings (e.g. at the EPO) and a nice broad one for enforcement in the courts. Such strategies are particularly tempting in Europe where file wrapper estoppel is limited and where the national courts show varying degrees of adherence to the findings of the EPO.

In our article about biological deposits under the Budapest Treaty, we explored the deadlines and formalities for depositing microorganisms so that the deposit can be referenced in a patent application. For the present article, we reviewed the prosecution history of over 45 cases at the European Patent Office (EPO). We found that, when made correctly, a reference to a deposited microorganism can be very helpful in overcoming a range of objections from the EPO’s examiners.

The first enlargement of the UPC and Unitary Patent (UP) territory will happen on 1 September 2024, when Romania’s ratification of the UPC Agreement enters into force. Any UPs that are registered at the EPO on or after 1 September 2024 will cover eighteen countries: Romania and the seventeen countries that have been included since the UP/UPC system went live on 1 June 2023. The deadline for requesting registration of a UP is one month after the grant date of the underlying European patent.
