Despite periodic moments of public outcry over abuses of state and corporate power enabled by egregious data practices (and decades of bipartisan lip service to the importance of “protecting privacy”), Congress has repeatedly failed to pass comprehensive privacy legislation.

UPDATE 6/27/24, in response to the news that the markup was cancelled, Eric Null— Co-Director of CDT’s Privacy & Data Project — issued the following statement:“Today, the House Energy & Commerce Committee made the right call to cancel its markup of the updated American Privacy Rights Act, which lacked vital and necessary protections for civil rights and algorithmic transparency that were included in prior bill drafts and in the American Data Privacy and Protection Act from 2022.

The EU-U.S. Trade and Technology Council (TTC) has been working to identify areas of cross-governmental cooperation on digital identity technology, including a mapping exercise comparing some parts of existing regulation and standards. CDT welcomes cross-governmental transatlantic coordination of technology standards for digital identity.
