It’s a summer day in one of Sweden’s most popular holiday areas, but I’m not here to enjoy the sunshine. I’m about to go to jail. Västervik Norra, a medium-security prison for 255 inmates on the Eastern shore of Sweden, is not a friendly place, rather at odds with its surroundings. The waiting room is half-heartedly decorated with a few plastic toys. I’m one of only three visitors that day. Most inmates here are serving time for violent crimes, kidnappings and the like.

Damit sich Open Access durchsetzt, braucht es eine breite Akzeptanz des Publikationsmodells in der Wissenschaft. Unter deutschen Forschenden hält sich hartnäckig das Vorurteil, dass die Publikation unter freien Lizenzen wie Creative Commons Namensnennung (CC BY) – genau wie die Veröffentlichung der Forschungsergebnisse ohne Paywall eine zentrale Voraussetzung für Open Access – wirtschaftliche Nachteile für die Autor*innen bedeuten würde. Diese Furcht ist weitgehend unbegründet.

For years, my colleagues in the European Parliament and I worked on the EU copyright reform – on improving the Commission’s original proposal, but above all, on preventing the worst. More than 5,000,000 signatures made the petition against Article 13 the biggest in EU history. Many activists invested their time and passion into the fight. By taking to the streets, 200,000 protesters ensured that our concerns became impossible to ignore.

In the evening of February 13, negotiators from the European Parliament and the Council concluded the trilogue negotiations with a final text for the new EU Copyright Directive. For two years we’ve debated different drafts and versions of the controversial Articles 11 and 13. Now, there is no more ambiguity: This law will fundamentally change the internet as we know it – if it is adopted in the upcoming final vote.

Am Dienstag, dem 16. Juni hat der Rechtsausschuss des Europaparlaments meinen Bericht über die Evaluation des EU-Urheberrechts angenommen. Zu den meisten Punkten meines Berichts konnte ich gemeinsam mit allen Fraktionen Kompromisstexte aushandeln, zu einem Thema konnten wir uns aber nicht einigen: dem Recht, Abbildungen öffentlicher Gebäude oder Skulpturen frei zu verwenden, der so genannten Panoramafreiheit.

Wer im vergangenen Sommer das Urteil des Bundesgerichtshofs in den Verfahren YouTube II und Uploaded III (BGH, Urteile vom 2. Juni 2022 – I ZR 140/15, I ZR 53/17 u.a.) nur oberflächlich verfolgt hat, könnte zu dem Schluss kommen, dass die Zeit der Störerhaftung in urheberrechtlichen Streitigkeiten endgültig vorbei ist.
