A man who was found sleeping over the wheel of a crashed van has had his conviction for drug driving overturned after an appeal court heard there was “zero evidence” he had been driving within three hours of a blood sample being taken. Derek Smith (43) from an address at Holly Road, Donnycarney, Dublin 3 had pleaded not (NOT) guilty to drug driving under Section 4(1) of the Road Traffic Act 2010 in the District Court. He was found guilty by Judge Grainne Malone.

A driver who got a one-year ban for using his phone in a parked car in an attempt to record a garda has had his disqualification lifted on appeal. The District Court Appeals Court heard that Daniel Mofiyinfoluwa Kotun-Akinbode (24) was not using his phone while driving when he was initially pulled over, but he later took it out when he was parked with the engine running in order to record the conversation with the garda.

A young man who produced an unopened Stanley Blade while trying to “act as a peacekeeper” in a fight on a Centra shop floor has had his six-month jail sentence overturned on appeal. The District Court Appeals Court heard that Luke McKee (23), who completed his Leaving Certificate while living in a homeless hostel and is due to complete an apprenticeship, had the blade with him as part of his work.

A learner driver who ran a stop sign on a busy Dublin road, causing him to almost collide with a garda car and a child on a bicycle, has failed to convince a court that his conviction for dangerous driving should be overturned. Jijo George (43) with an address at Chapel Street, Balbriggan, Co Dublin had pleaded not guilty to dangerous driving under Section 53 of the Road Traffic Act, 1961 in the District Court.
