The mandatory duty on employers to take reasonable steps to prevent sexual harassment in the workplace (the preventative duty) came into force a few weeks ago, just in time for this year’s Christmas parties. Sexual harassment means unwanted conduct of a sexual nature that has the purpose or effect of violating a person’s dignity or creating an intimidating, hostile, degrading or offensive environment.
