Talks (Koalitionsverhandlungen) between the centre-right CDU/CSU and centre-left SPD to form a new German government concluded in a coalition agreement reached on April 9, 2025. On 27 September 2024, the European Commission ("EC") published draft rules defining "low-carbon hydrogen" and derivative "low-carbon fuels" in the EU (the "Draft Low-Carbon Hydrogen DA"). A public consultation is now open until 25 October 2024.1 Low-carbon hydrogen includes hydrogen produced from fossil energy sources (with carbon capture and storage ("CCS")), colloquially known as "blue" hydrogen, or from nuclear generated electricity, known as "pink" hydrogen.

On May 30, 2024, the council of ministers of the German Federal Government adopted a draft bill (Bundesrats-Drucksache 266/24) allowing permanent storage of carbon dioxide (Gesetz zur Demonstration der dauerhaften Speicherung von Kohlendioxid – Kohlendioxid-Speicherungsgesetz – KSpG). The bill would amend a 2012 law that only provided means to test (“demonstrate”) various technologies of carbon capture and storage.
