一、 越南著作权制度确立及发展 越南著作权保护制度始于1986年颁布的《著作权保护法令》，其后在1994年进行修订并重新颁布。而随着1995年10月越南《民法典》的制定，该部法律被废除。 越南现行著作权及邻接权保护制度相关法律为《民法典》和《知识产权法》。《民法典》于2006年1月1日起予以实施，其中第六编“知识产权与技术转让”对知识产权的相关内容进行了规定，涵盖著作权及邻接权的主体、客体、内容、保护期、转让等原则性规定。而涉及知识产权内容的进一步具体规定则在2006年7月1日生效的《知识产权法》中予以明确。该部法律的颁布实施是为了遵守越南加入TRIPS协议的法律义务及履行《美国-越南双边贸易协定》中所作的承诺。在《知识产权法》中承认并保护了多种知识产权，其中包括著作权以及相关权，相关的规定分别位于总则、著作权及邻接权以及知识产权保护编。...
