The ECT is an international treaty that requires contracting parties, among other things, to provide fair and equitable treatment to investors, to avoid discrimination and to compensate investors in case of expropriation. It also provides investors with a right to seek damages through international arbitration where host government actions violate the minimum standards set out in the treaty.

However, regardless of the final outcome, climate change litigation and arbitration are expected to increase and counterclaims could be increasingly used by states as an opportunity to raise climate change-related claims in investor-state arbitrations. The UK announced its intention to withdraw from the ECT on 22 February, due to what it described as the failure of efforts to align the Treaty with its net zero commitments.

The announcement, made on 22 February, followed a statement in September 2023 by UK energy security minister Graham Stuart that the UK would be reviewing its membership of the ECT if plans to update it were not adopted. The announcement does not in itself produce any legal effects. The formal withdrawal of the UK’s membership requires one year’s written notice, and the treaty’s ‘sunset clause’ will continue to offer then existing covered investments in the UK protection for 20 years.
