I first want to thank you all for your service. It doesn’t matter whether you served one day or 30 years, you served. Less than 2% of our population in the U.S. has or is currently serving in the entire armed services. Every military career has its ups and downs. I thank God for those that have answered the call to serve our nation and protect our way of life for over 249 years.

In the 1823 decision of Johnson v. M’Intosh, Chief Justice John Marshall formulated the international law of colonialism. Known as the Doctrine of Discovery, Marshall’s opinion drew on the practices of European nations during the Age of Exploration to legitimize European acquisition of territory owned and occupied by Indigenous peoples. Two centuries later, Johnson—and the international law of colonialism—remains good law throughout the world.

Judges have described it as “gibberish”, “obvious nonsense”, “largely incoherent, if not incomprehensible” and “gobbledygook”. It involves grand claims like “Magna Carta means you do not need to pay your mortgage”, or “the introduction of decimal currency means income tax is illegal”. It’s the strange and growing phenomenon of pseudolaw. Pseudolaw looks a bit like law. It uses legal texts and sounds kind of like something a lawyer might say. But it does not follow normal legal rules.

On October 14, Australians said “no” to the Voice to the Parliament, choosing not to enshrine an Aboriginal and Torres Strait Islander advisory body in the Constitution. Many Indigenous Australians are devastated, seeing the result as a dismissal of their place and status on this continent. But this is not the whole story.
