The Canada-U.S.-Mexico Agreement (CUSMA), which succeeded the North American Free Trade Agreement (NAFTA) in July 2020, contains a number of changes that address some common criticisms of international trade agreements. For example, CUSMA includes stronger enforceable labour provisions and phased out investor-state dispute settlement, at least between Canada and the United States.

Headlines following Donald Trump’s election victory focused largely on the influence of personalities, such as Elon Musk or Robert Kennedy junior, and single issues, such as how US tariff hikes would affect New Zealand’s exports. But this oversimplifies and diverts attention from the more systemic challenges a second Trump presidency will pose for Aotearoa New Zealand’s economy. ACT Party leader David Seymour has said the goal of his Treaty Principles Bill is to stimulate an overdue conversation on te Tiriti o Waitangi/Treaty of Waitangi. At that level at least he has succeeded. His proposal to rewrite te Tiriti through new legislation has certainly triggered debate – to the point where the most profound constitutional question of all has been asked on the floor of parliament: did Māori cede sovereignty when they signed te Tiriti in 1840?
