Now that independent schools are well into the 2024-2025 school year, independent schools are turning their attention toward enrollment and re-enrollment season for the 2025-2026 school year. Before issuing enrollment contracts, independent schools would be wise to review and fine-tune their enrollment contracts with an eye to issues that arose in years past to ensure that those most pressing issues impacting the relationship between the school and its enrolled families are contemplated.

Increases to the Salary ThresholdIn a 2024 Final Rule, the Department of Labor (DOL) announced that it would be increasing in two phases the salary threshold for employees to be exempt from overtime. Specifically: As of July 1, 2024, the threshold increased to $844 per week/$43,888 annualized, up from the current threshold of $684 per week/$35,568 annualized; and As of January 1, 2025, the threshold will increase again to $1,128 per week/$58,656 annualized.

In 2022, and as previously discussed here, two separate federal district courts each held that an independent school's status as a 501(c)(3) tax-exempt organization is considered a school's receipt of federal financial assistance. Both decisions were departures from prior precedent and legal interpretation.
