As we begin another trip around the sun, there are a few eDiscovery topics that will remain top of mind through all 12 months of 2025 (and beyond). The use of next-generation AI in the legal industry is certainly near the top of that list. While AI in eDiscovery and specifically document review is a rather small portion of that, it is an area in which Generative AI has established a foothold and represents a unique opportunity to explore what the latest AI can do in our field.

In my last post, I suggested a best practices GenAI first pass review process is a TAR 1.0 workflow. I stand by that. In broad strokes, they are the same. That said, there is a difference, with pros and cons, in the “model training” portion of the workflow. On August 1, Missouri Governor Michael Parson issued Executive Order 24-10 (the EO), a bold move aimed at addressing consumer safety concerns surrounding unregulated psychoactive cannabis products. The EO sparked a legal battle with the Missouri Hemp Trade Association (MO Hemp), which claims that by designating these products as adulterated and imposing an embargo under the EO, the Missouri Department of Health and Senior Services (DHSS) violated Missouri law.

TAR – More Process than TechnologyAI Washing is likely a phrase you’ve heard at least once in recent months. It refers to exaggerations or false claims around the use of AI in products or services. I didn’t hear the term in the 2000’s but you could say that “TAR Washing” was common then. Some offered to provide TAR solutions by claiming the “T” in Technology Assisted Review could include technology like concept clusters, near duplicate detection, email threading etc. This was a stretch.
