While most state data breach notification statutes contain similar components, there are important differences, meaning a one-size-fits-all approach to notification will not suffice. What’s more, as data breaches continue to rise, states are responding with increasingly frequent and divergent changes to their statutes, creating challenges for compliance. Specifically, state and federal regulators want to close the gap between HIPAA-protected data and other consumer health data. HIPAA only regulates protected health information maintained by covered entities such as hospitals, clinics, health care providers, pharmacies, health plans and health care clearinghouses, and their business associates.
