While the political climate has shifted, the legal landscape remains largely unchanged. Panic-driven rollbacks are premature, and they often do more harm than good.

On April 8, the Supreme Court issued a 7-2 decision in Office of Personnel Management v. American Federation of Government Employees to pause a lower court’s order to rehire fired federal workers. This case stemmed from the Donald Trump administration’s layoffs in February of over 24,000 probationary federal employees across multiple departments, under the guise of cutting government waste.

The Trump administration began fulfilling a key campaign promise immediately after taking power: the dismantling of diversity, equity, and inclusion (DEI) initiatives in the federal government and beyond. This action, taken largely through a slew of executive orders, have left nonprofit leaders confused about their options. And the language used in these executive orders raises concerns about legal risks for nonprofit organizations.
