The purpose of Georgia's and Kentucky’s new donor intent protection acts is to allow donor standing for violations of donor-imposed restrictions for endowment funds that are governed by an endowment agreement. Georgia and Kentucky are now the third and fourth states to allow donor standing for endowment violations, following Iowa and Kansas. The Ohio and Vermont legislatures are considering similar efforts.

The purpose of Kansas’ Donor Intent Protection Act is to provide recourse to an individual donor (or legal representative) when a recipient fails to follow restrictions in the endowment agreement. Kansas is now the second state to allow donor standing under UPMIFA, following Iowa, which allowed for donor standing when it first adopted UPMIFA in 2008.

At a Glance The New Hampshire Supreme Court’s decision clarifies that the traditional common law “special interest” standing doctrine is abrogated in cases involving completed charitable gifts. Appellate level decisions on UPMIFA are rare, so it’s possible — even likely — that courts across the country will look to this decision for guidance in future cases involving “special interest” standing under UPMIFA.

In 1845, Frederick Douglass, after 20 years as a slave and seven years a free man, published his first autobiography, “Narrative of the Life of an American Slave.” In an appendix Douglass was keen to distinguish two types of Christianity that were antithetical. Douglass first identified the “Christianity of Christ,” a faith expression known to be merciful and just, in keeping with the law, the prophets and the love of Jesus.
