Communications Commission's (FCC and Commission) new and expansive data breach notification
Order, approved on a 3-2 vote at the Commission's December
13 Open Meeting. Much of this coverage has
focused on the Congressional Review Act (CRA), a topic that
commenters raised in response to the Notice of Proposed Rulemaking and that
Commissioners Carr and Simington cited as a major legal barrier to the
new rules in their dissents.

The Fifth Circuit's recent decision in National Press Photographers
Association v. McCraw threatens to dilute the First Amendment
rights of photographers and filmmakers using uncrewed aircraft
systems (UAS), and undermine federal control of the airspace. The
court's holdings on both the First Amendment and preemption are
troubling, and undoubtedly will have an impact on UAS operations in
Texas; they may also provide momentum for similar regulatory
barriers in other states.

By next year, consumers may be able to scan a QR code on their
connected devices for information about cybersecurity protections
that are built into their devices. Details on the program are still
being worked out, but the general framework was announced this week
