On November 28, 2023, the European Commission(EC) adopted its first list of Projects of CommonInterest (PCIs), i.e., projects withinthe EU territory, and Projects of Mutual Interest(PMIs), i.e., projects connecting the EUwith other countries, including 166 projects implementing theEuropean Green Deal. The list was published in the EU OfficialJournal on April 8, 2024.

On February 6, 2024 the Council of the EU and the European Parliament agreed a provisional version of the Net-Zero Industry Act (NZIA), which is now expected to be formally adopted by the end of April 2024. This will follow the imminent publication of the Critical Raw Materials Act (CRMA) These regulatory initiatives support the February 2023 "Green Deal Industrial Plan for the Net-Zero Age" (the Net Zero Plan).

On December 27, 2023, the European Union's new Anti-Coercion Instrument (Regulation 2023/2675) (the 'ACI') came into force. It aims to protect the European Union (the EU), and its Member States, from economic coercion by third countries. This could be a double-edged sword for businesses, however. While it provides a mechanism for shaping the EU response to injurious third-country measures, it also generates additional regulatory risk for those operating both within and outside the EU.

On 7 December 2023, the European Commission (Commission) adopted guidelines on the application of an EU antitrust exemption for sustainability agreements involving producers of agricultural products (the Guidelines). Article 210a of Regulation (EU) 1308/2013 (CMO Regulation) exempts restrictions of competition in agreements in the agriculture sector that are indispensable to achieving sustainability standards higher than EU or national mandatory standards.
