It has been nine months since the creation of the UK Office of Trade Sanctions Implementation (OTSI) was announced, as a sister regulator to the Office of Financial Sanctions Implementation (OFSI), dealing with trade sanctions breaches. However, it has only been in recent weeks that the parameters for the operation of OTSI have been made public, with the Trade, Aircraft and Shipping Sanctions (Civil Enforcement) Regulations 2024 (TASS) being laid before Parliament.

UK fraudbusters have beefed up powers since the beginning of the year, when the Economic Crime and Corporate Transparency Act 2023 came into force. The legislation gives the Serious Fraud Office fresh information gathering powers, with the agency’s director, Nick Ephgrave, welcoming the additions to his investigative toolkit. But to assess whether Ephgrave’s confidence is well-founded, it is worth looking at the nature and scope of the powers and considering how these might be applied in practice.
