On Wednesday, November 13, 2024, the National Labor Relations Board ("NLRB") issued a decision prohibiting captive audience meetings — mandatory meetings held during work hours to explain the employer's position on union-related matters — finding that they violate National Labor Relations Act ("NLRA") Section 8(a)(1) which forbids employers to "interfere with, restrain, or coerce employees in the exercise" of their labor rights. The decision overrules nearly eighty years of precedent.

On January 10, 2024, the U.S. Department of Labor (DOL) published its Final Rule amending the criteria used to determine whether a worker qualifies as an employee or an independent contractor under the Fair Labor Standards Act (FLSA). The Final Rule is available here. While the Final Rule goes into effect March 11, 2024, legal challenges are expected and may impact when or if the Final Rule takes effect.

A sweeping proposed bill (A1278B) amending the New York Labor Law to make unlawful any non-compete agreement has passed the state Assembly and is heading to New York Governor Hochul. If signed, the bill would cover all non-compete agreements entered into or modified 30 days after the bill’s effective date. Notably, the pending bill does not require the rescission of existing non-compete agreements.
