Like many Americans, I follow criminal justice developments closely. The arrest and coming prosecution of Sean Combs, also known as P. Diddy, among other things, will likely remain in the headlines for months, and perhaps years, and promises to be fascinating. Prosecutions related to the January 6, 2021, riots at the Capitol remain ongoing.

The summer of 2013 was my first summer in prison after being incarcerated for blowing the whistle on the CIA’s torture program. When summer arrived in Loretto, Pennsylvania, I had already made a handful of friends, most of whom came from the prison’s “Italian” population. One warm day in the spring, I mentioned to one of the Italians that I hadn’t spent a summer in Pennsylvania since my high school years.

Late on August 3, Secretary of Defense Lloyd Austin threw out a plea deal, without comment, that would have seen three of the most notorious September 11 terror suspects at Guantánamo imprisoned without parole for the rest of their lives. The deal was that they would plead guilty to murder and to providing material support to a terrorist group and, in exchange, they would remain at Guantánamo until their deaths.

The Justice Department has made something of a sport of attacking people on “national security” grounds. Just look at what has happened in recent years to Tom Drake, Chelsea Manning, Jeffrey Sterling, Daniel Hale, and this writer. The Justice Department’s attack dogs told Tom Drake and Chelsea Manning that they had the “blood of American soldiers” on their hands. That was an outrageous lie, of course. They told Jeffrey Sterling that he had aided Iran’s nuclear program.
