There’s no doubt that waterproof and oil-proof materials serve a wide range of valuable purposes—for everything from raincoats and yoga pants, to fast food wrappers, to cosmetics and dental floss. The issue coming increasingly to light, however, is that some of the class of materials used in these products—perfluoroalkyl and polyfluoroalkyl substances (“PFAS”)—have been associated with negative health and environmental effects. That’s not to say that every form of PFAS is dangerous.

The amended language of Federal Rule of Evidence 702, which governs the admissibility of expert testimony in federal court, takes effect on December 1, 2023. Even though the Advisory Committee comment stresses that it intended no substantive alteration, and sought only to clarify the Rule’s proper application,[1] the changes are not merely semantic.

Air carrier liability has been governed by international convention nearly since the inception of the technology. In 1903, the Wright Brothers infamously conducted powered flight at Kitty Hawk. In 1919, the first reported scheduled international passenger air service occurred. Just a decade later by 1929, an international treaty known as the Warsaw Convention harmonized international law of air carrier liability.
