In the second part of this two part episode, Scott welcomes Professor Michael McConnell, Director of the Constitutional Law Center at Stanford Law School and senior fellow at the Hoover Institution. From 2002 to 2009 he served as circuit judge on the US Court of Appeals for the 10th Circuit. He teaches courses on constitutional law the first amendment and interpretive theory. He has published widely in constitutional law, especially church and state, equal protection, and separation of powers.

In a disturbing number of incidents in recent years, local governments have withheld critical services, resulting in destruction and death. Consider, for example, the mass shooting in Uvalde, Texas, on May 24, 2022. Law enforcement officers waited for 77 minutes inside Robb Elementary School before confronting and killing the active shooter who murdered 21 people—19 children and two teachers—and trapped 36 people in a room, many of whom were shot and dying.
