For more than 50 years, New Jersey has been a national leader in the adoption and enforcement of environmental protection statutes including measures to address air and water quality, hazardous waste, and areas of critical environmental concern. While some minor gaps in the environmental statutory array remain to be filled, over the past few years the focus of legislative attention has clearly shifted to clean energy, climate change, and sustainability issues.

The New Jersey Supreme Court’s docket includes a case that will require the court to interpret an exemption to the Highlands Water Protection and Planning Act (the Highlands Act), N.J.S.A. 13:20-1 et seq. Concurrent resolutions have been introduced in the Legislature that if adopted and subsequently approved by the electorate would amend the New Jersey Constitution “to ensure the people’s environmental rights.” SCR-43 and ACR-119. The Senate version of the so-called “Green Amendment” has two primary sponsors and 17 co-sponsors. Similar measures have been introduced since 2017.
