For the past several months, the Senate Environment and PublicWorks ("EPW") Committee has been reviewingrecommendations on how to overhaul the Superfund process as setforth in the Comprehensive Environmental Response, Compensation,and Liability Act ("CERCLA") to expedite the early stagesof the Superfund process. During an April 9, 2025 Committee hearing, senators from bothparties expressed their support for the effort, although each partydiffered in their approach to streamlining the process.

The proposed rule "clarifies" that the PFAS chemicalwill be automatically added to the TRI list of chemicals as ofJanuary 1 regardless of whether the EPA has published a ruleupdating the TRI list.

The U.S. Environmental Protection Agency (EPA) is proposing to add 16 individually listed per- and polyfluoroalkyl substances (PFAS) and 15 PFAS categories―representing more than 100 individual PFAS―to the Toxics Release Inventory (TRI) list of toxic chemicals subject to reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA).
