On October 31, 2023, a Missouri jury issued a $1.8 billion verdict against the National Association of Realtors (“NAR”) and major real estate brokerages, finding that NAR’s rule requiring home sellers to pay the buyer’s broker commission amounted to a conspiracy in violation of antitrust laws.[1] Multiple class action lawsuits with similar allegations seeking over $200 billion in damages were filed immediately after the verdict. The DOJ has also been investigating NAR for similar conduct.
