The decades-long fight over net neutrality appears to beover. In one of the first appellate decisions since the Supreme Courtof the United States overturned Chevron deference in Loper Bright Enterprises v. Raimondo(2024), the U.S. Court of Appeals for the SixthCircuit's decision in Ohio Telecom Association v. FCC(2025) held that the Federal Communications Commission (FCC) lacksauthority to reinstate its 2015 net neutrality rules.

The Office of Management and Budget (OMB), part of the Executive Office of the President, recently issued a memorandum (the Memorandum) containing requirements and recommendations for executive agencies regarding those agencies' use of artificial intelligence (AI). It marks the first effort to establish an AI governance structure for the federal government, which was mandated by the October 2023 Executive Order on AI that we have previously discussed here and here.

Artificial Intelligence (AI)-generated robocalls may trick some consumers into thinking they are being called by a human being, but the Federal Communications Commission clarified in a recent AI Declaratory Ruling that it will not be fooled. Moving forward, all AI-generated robocalls will be treated as artificial or prerecorded voice calls for purposes of the Telephone Consumer Protection Act (TCPA) and will require a called party’s prior express consent.

The Federal Communications Commission recently adopted a Notice of Proposed Rulemaking (NPRM) to reestablish its authority over broadband internet access service (BIAS) by reinstating its net neutrality rules. The NPRM largely follows the framework set out in an order adopted by the FCC in 2015 during the Obama administration (the 2015 Order), which was repealed by the FCC in 2017 during the Trump administration (the 2017 Order).
