A patient’s claim that a New Mexico hospital’s failure to properly treat his pediatric leukemia cost him his best chance for survival or a better outcome can’t succeed, a state appeals court said. A loss-of-chance medical malpractice claim requires a plaintiff to demonstrate that they suffered actual physical harm as a result of the malpractice, the New Mexico Court of Appeals said Monday.

Two University of Kentucky doctors will face a lawsuit over their alleged misreading of a patient’s cardiac MRI during the Covid-19 pandemic, resulting in a stroke, a state appeals court said. A state law giving health-care providers immunity from suit for injuries arising during the public health-care emergency didn’t apply because there was no connection between patient Max Thompson’s treatment and the virus, the Kentucky Court of Appeals said in an unpublished opinion April 18.

Premera Blue Cross facially discriminated against transgender teens by adopting a general policy that excludes chest surgery coverage for minors transitioning from female to male or nonbinary, a federal court said.
