Two federal judges on Thursday significantly limited the Trump administration’s ability to enforce a series of orders it’s issued telling the nation’s schools and colleges to eliminate much of their diversity, equity, and inclusion programming or risk losing federal funds. The judges in Maryland and New Hampshire both found the Trump administration’s anti-DEI efforts didn’t pass legal muster, but for slightly different reasons.

The Trump administration wants the nation’s schools to certify that they’re not using “illegal DEI practices” by April 24 in order to continue receiving federal education funds. In a letter sent April 3, the administration gave state education chiefs 10 days to sign a certification saying they’re complying with Title VI of the Civil Rights Act, which prohibits race-based discrimination in federally funded programs.
