A new Bill, Closing Loopholes No 2, has passed Parliament on 12 February 2024, introducing new reforms allowing employees to disconnect outside work hours. The legislation has come about from a push by the Greens party to strengthen employees' rights regarding their time away from work. What is an employee's 'right to disconnect'? Employees will now have the right to refuse to monitor, read or respond to contact, or attempted contact, from an employer outside their required working hours.

A ruling earlier this year from the Fair Work Commission has changed the rules around employee leave during office closure period. As a result of this 4 yearly review of modern awards, from 1 May 2023, employers may no longer require an employee to take unpaid leave during an office closure period. This is an extensive list of awards and includes the Clerks- Private Sector Award, and the General Retail Industry Award.
