On December 3, 2024, the Consumer Financial Protection Bureau (CFPB) issued a notice of proposed rulemaking (NPR) – Protecting Americans from Harmful Data Broker Practices. The CFPB’s proposal would amend Regulation V, which implements portions of the Fair Credit Reporting Act (FCRA), in ways that would materially expand the FCRA’s reach and, in certain circumstances, serve as a reversal of long-standing legal interpretations. Comments on the proposed rules are due to the CFPB by March 3, 2025.

On August 13, 2024, the Consumer Financial Protection Bureau (CFPB) issued an advisory opinion stating that contracts for deed are “credit” under Regulation Z, and therefore subject to its myriad requirements. Unlike a traditional mortgage, a contract for deed is a home sale directly financed by the seller where the seller retains legal title of the home until the borrower completes the course of payments.
