EU-domstolen blåstempler en udbudsmodel, hvor nr. 2 skal matche nr. 1’s priser på den største delaftale, for at få tildelt den anden – og mindre – delaftale. Blåstemplingen sker med henvisning til, at modellen var beskrevet klart, og, at der ikke i forbindelse med tildelingen skete en forhandling, hvor tilbudsgiverne blev givet adgang til at forbedre deres tilbud. EU-Domstolens præmisser kan godt åbne for endnu mere kreative løsninger.

2023 was a relatively quiet year in Danish online gambling. The year saw the introduction of the requirement to identify yourself when placing bets in brick and mortar betting shops(!) and a couple of other interesting decisions. However, we are now looking at a big change to the Danish Gambling Act in 2024, so 2023 will soon be forgotten. First of all, it is of note that Danish Parliament has agreed on a draft amendment act to the Danish Gambling Act (the “DGA”).

Retten i Glostrup har den 29. december 2023 som følge af, at sagsøgte (klager) valgte at tage bekræftende til genmæle, fundet, at Albertslund Kommune ikke havde tilsidesat udbudslovens § 55, jf. § 61, stk. 1, ved at have gennemført konkurrenceudsættelsen af delaftale 2, 3 og 4 som et udbud med forhandling i henhold til udbudslovens §§ 61- 66.
