The U.S. Court of Appeals for the Federal Circuit sitting en banc recently overruled the long-standing test for determining obviousness of design patents in LKQ Corporation, Keystone Automotive Industries, Inc. v. GM Global Technology Operations, LLC. Almost immediately after the Federal Circuit handed down its opinion, the U.S. Patent and Trademark Office (the USPTO) issued new guidelines for the examination of design patent applications.

On April 23, the Federal Trade Commission (FTC) voted to adopt a new rule that bans noncompete agreements that prevent employees from working for competitors or starting a competing business after they end employment. The FTC’s final rule would ban new noncompete agreements for all workers across the country.

As previously discussed by our firm in prior newsletters, Congress, in 2021, passed the Corporate Transparency Act (the Act) requiring reporting companies to provide certain company and beneficial ownership information to the U.S. Department of Treasury’s Financial Crimes Enforcement Network (FinCEN), unless such entity falls within one of the 23 types of entities that are exempt from the reporting requirements.
